Beginning November 3, 2025, the New York State Lead Rental Registry Act goes into effect, requiring property owners in designated “Communities of Concern” – including Albany County, Erie County, and other Upstate regions – to register their rental properties and undergo periodic lead hazard inspections.

About the New York State Lead Rental Registry Act

Passed in 2023, this statewide initiative strengthens lead-safety protections for tenants living in older multifamily housing. The law applies to:

  • Residential buildings built before 1980
  • Properties with two or more rental units
  • Locations designated by the New York State Department of Health as “Communities of Concern” (based on elevated childhood blood lead levels and housing age)

Property owners in these areas must:

  • Register eligible rental properties with the state’s Lead Rental Registry.
  • Complete lead hazard inspections conducted by certified professionals.
  • Remediate or control any identified lead hazards.
  • Repeat inspections every three years to maintain compliance.

Failure to comply could result in fines, enforcement actions, or rental restrictions, making proactive planning essential for all multifamily housing stakeholders.
